DISSOLUTION: AN ALTERNATIVE TO TRADITIONAL DIVORCE

In a marriage dissolution, both parties negotiate and sign a separation agreement and file a petition in the court jointly. Prior to filing in court, they will have identified and reached agreement on all issues that must be addressed in a divorce matter including designation of a residential parent, allocation of parental rights, visitation, child support, spousal support, division of property assets, payment of debts and more. This is different than a traditional divorce in that fault grounds are not an issue and, because there is no court involvement until an agreement is reached, all the temporary orders and possible hearings that might occur in a divorce case are avoided.

If you and your spouse are on relatively good terms and feel that you can work together to reach an agreement to all terms to end your marriage, dissolution may be the best option to consider. A dissolution not only will save time, it can reduce legal fees, court costs, avoid conflict and confrontation and is often less painful emotionally for all parties involved.

Joseph Nigh and our divorce attorneys all understand how traumatic it can be to end a marriage. We are here to help you get through this difficult period as amicably and quickly as possible. Joseph Nigh and our divorce attorneys are here to assist you throughout the marriage dissolution process, advise you of your rights and potential obligations and prepare a separation agreement that protects your interests. We offer the option of hiring a retired judge to perform the final hearing in our office: the judge will then sign a decree and the marriage will be terminated, avoiding the delays and inherent inconveniences of attending court for the final hearing.

WHEN A DISSOLUTION OF MARRIAGE IS NOT AN OPTION

In the event that you do face a dispute with your spouse on any issues and find that marriage dissolution won’t work after all, we can also represent you in the divorce process.

If you are dealing with the end of your marriage or relationship you must address some of the most difficult decisions of your life. How you answer these questions today will be critical tomorrow and well into your future. That’s why you need the full support of an experienced lawyer you can trust.

Joseph believes in a dual focus approach to litigation. He feels that an attorney should always work to resolve a case without a trial to avoid the costs, both financially and emotionally, that clients have with litigation. He also believes at the same time that an attorney should be preparing the case for trial. This dual focus allows the attorney to be prepared for all issues that arise and provide the client with the best alternatives and results in their cases.

At NLG we understand that each client and each case is unique. Our ability to understand this helps us achieve favorable results for our clients. We believe clients should be informed of the legal process and how their issues will likely be dealt with by the courts. It is our experience in the courtroom that allows us to provide this information.

Many cases require the use of experts. We regularly work with accountants, psychologists, counselors, and economists to assist us in providing the best information to the court on behalf of our clients. It is the ability to identify the need and benefit of using these experts, along with our experience working side-by-side with these experts that gives us a strategic advantage over other law firms.
